Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Lumina CRM (the “Service”), operated by Luminatech (“Lumina”, “we”, “us”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for the information you provide, for maintaining the confidentiality of your login credentials, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

2. Workspaces and roles

The Service is organized into workspaces. The person who creates a workspace, and the administrators they designate, control its settings, members, and data. If you are invited to a workspace, the administrator of that workspace may manage your access and view content you contribute. You are responsible for ensuring you have the right to invite others and to add any data you upload.

3. Acceptable use

You agree not to:

• Use the Service to violate any law or the rights of others.
• Upload or transmit malware, or attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer, resell, or sublicense the Service except as permitted by law.
• Send unlawful, harassing, deceptive, or unsolicited bulk communications using the Service.

4. Your content

You retain all rights to the data and content you and your team submit to the Service (“Your Content”). You grant us a limited license to host, process, and display Your Content solely to operate and provide the Service to you. You are responsible for Your Content and for having the necessary rights and consents to use it within the Service.

5. Third-party services

The Service may integrate with third-party services, such as Google Sign-In. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, and your use of them is at your own risk.

6. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms.

7. Plans, trials, and fees

Some features may be offered as part of free or paid plans. Where fees apply, they will be described at the point of purchase. Unless stated otherwise, fees are non-refundable except as required by law. We may change pricing prospectively with reasonable notice.

8. Availability and changes

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. We will try to give reasonable notice of material changes that adversely affect your use.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure for us, or for prolonged inactivity. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination will survive.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, Lumina and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amounts you paid us for the Service in the twelve months before the claim arose.

12. Indemnification

You agree to indemnify and hold harmless Lumina from claims, damages, and expenses arising from your misuse of the Service, Your Content, or your violation of these Terms or applicable law.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
